Can a school declare me a first-year student (for loan eligibility) if I already have a Bachelor's degree?

Question

I have enough credits for 2 bachelor's degrees. The school will only transfer in the credits that will fit their 2-year degree program (which is 38 credits in my case); therefore, I am only a first year student. As a first year student, I can only get 3500 in loans. Tuition alone will be 4500 for the year.

Can they make that determination? Isn't that determined by the Dept of Ed?
