Can a separated spouse cash a check written in BOTH names with one signature in an old checking acct.

Question

I am legally separated and my X deposited a check written in BOTH names, with only his signature into an old savings acct/joint. WITHOUT my knowledge, he then withdrew on this money. I just found out this happened 3 weeks again. What can I do legally in AL? All investment money was to be frozen according to the separation agreement

well you can have your lawyer sue him for the money!!! and i guess worse case it is against the law and he could do jail time!!!!

If the check was written to both parties and it was deposited in a joint account there isnt much you can do, when you are seperated its your responsibility to make sure joint accounts are closed out for that reason.  Be careful with any tax returns all he would have to do is sign your name  and put it in that joint account.
