Can a softmodded xbox 360 be detected and banned from xbox live?

I am interested in trading for a modded xbox 360 on craigslist, and the guy says he plays it on xbox live every day, but I still want to make sure that it cant be detected by microsoft. If they ban the xbox from live service, it would be useless to me.

I work for MS and yes they the XBL servers detect all of this. That's the reason why there have been many updates recently for the last 2 months. You might get banned.

probably yes but what you could do is go to his house and ask him to play it just to make sure it works and you don't banned

Yes hes tricking you he knows that it will be detected only if you update stuff and this fall all 360 on xbox live will be forced to update for the new dash board so he's trying to get rid of it and some cash.
