Can a step-dad have a greencard holder deported?

My 19 year old girlfriend came here with her mother and has a conditional greencard. Her stepfather has decided he does not like me and told her he would have her deported if she continues to see me. She has enlisted in the Air Force (ships out in November) and plans to become a citizen. Once she is a citizen she wants to get married. In the meantime can he actually have her deported for not "following the rules of his house?" What she would like to do is live with me or get a place of her own but he has her petrified that he will have her and her mom deported. He has also taken away all of her communication tools. He locks up the home phone, took her cell phone, and locked her out of the computer. The only outside interaction she is allowed to have is when she is at work.

  1. No, he cannot deport her.  She can only be deported if she obtained the card illegally, has been arrested and convicted of certain crimes or multiple ones, and other things like that.


  2. Not unless she commits a felony.  She's 19.  She can move in with you.

  3. No he cannot have her deported. Do you know how many phone calls ICE receives on a weekly basis about frivolous things, do you know how many are taken seriously, zero. Violating the house rules is not a criminal offense, either State or Federal, the step father would be told to stop wasting their time and I wouldn't be surprised if he is the one who gets served for just that.

    Unless your girlfriend violates any State of Federal criminal acts then no harm will come to her. Immigration is a Federal matter and she and her mother will remain Permanent Residents of the United States until an immigration judge rules otherwise and not the step-father. The power he holds is zero, relax.

  4. Yes he could get her mum deported if he files for divorce (the mum and the stepdaughter have still the gc with condition).

    And if the mum has to go , I guess the daughter has to go too.

    then she is safe.... and as soon she is in the AF she is even more safer .
