my girlfriend went to court to fight being evicted by her discriminating, bullying, and harrassing apt manager. she wasn't mentally or emotionally prepared. she submitted 74pgs of damaging docs. that should have totally gone in her favor. instead of throwing her answer in his and his attorneys face, she couldn't do it.because i wasn't there to support her.i was incarcerated, so i couldn't.my question is. CAN SHE FILE AN APPEAL, IF SO, HOW MUCH TIME DOES SHE HAVE? IF NOT, WHAT ARE HER OPTIONS? THIS PRICK IS AN AS*HO#*. 74 PGS OF HARD EVIDENCE, LOST OR SALVAGABLE?

  1. You can appeal almost anything.  I'm sure you can appeal this.

Just remember that the higher up a dispute goes in the court process, the more expensive it becomes.

Honestly, it might not be worth it to appeal.

You might want to go to a legal aid clinic (or another lawyer) to find out the process for appealing the decision.

Most evictions can be stopped by paying the back rent (if that's the reason she's being evicted).

  2. legalzoom.com will help with the appeal process

  3. No, you can not appeal an eviction hearing, it is not a trial.

She had her time, your being there would not change a single fact.    I am sure that the judge looked over her "hard evidence".

If the landlord is so terrible why does she want to live there so badly anyway?

  4. She can appeal.  I am guessing that you are going by her explanation of what happened in court.  What if the landlord has 75 pages of evidence?  How about 175 pages?  You know that doesn't matter at all. Your girlfriend could win with "no"pages of evidence.

File now and help her when she has her court date for the appeal.

  5. Listen to me please , most of courts around the country support the landlord.

2nd --it very stupid to submitted 74 pgs of hard evidence ,,

this is a small claim court, the judge does  not have all day for your case, her respond should be around 2- 3 pages supported by pictures, statement from others , report from city inspector for health issue,  or housing authority. .

Do not waste your time and your money., it's too late.
