Can a wife who has left her husband after 7 weeks of marriage make a claim on his house?

They have lived together for 2.5 years and the house belongs to him, her name is not on the mortgage.She has walked out and wants a divorce and she has told him that she has seen a solicitor and they have stated that she has a right to go in and out of his house whenever she pleases ( he has changed the locks after she collected her things but has a few more things to collect) Is this correct? Our solicitor is on holiday so we just wanted some advice now to be prepared. IF YOU KNOW A GOOD WEBSITE FOR INFORMATION THAT WOULD BE HELPFUL.

  1. Every State is different- However the common name for a chick like this is: Gold Digger.  


  2. Gold diggers can ask for any thing they want.  What she will get is half the assets you acquired during the 7 weeks marriage. Peanuts I should imagine. Consult your CAB.

  3. I suggest he packs up all her other things (nicely) and returns them to her.  He should not give her a new key to the house.

    He needs to seek legal advice and fast.  She is bound to attempt to claim the house if she has any chance of succeeding.  Remember if they lived together for 2.5years she must have contributed to the house cost and that will count in her favour in terms of a claim.  I think if she went for it she is pretty mean.


  4. This happened to my brother. He bought the house while they were dating. Its 100% in his name, and so are the bills. Married for 2 months, she leaves, and tried to sue him for half of the house. She lost, as she never had her name on anything, he acquired it prior to the marriage. The marriage was too short for them to even consider her having put any "equity" into the home or get "accustomed to her status of living". She was laughed out of divorce court.

    Check the laws where you live, every state and country is different.

    Suggest the husband contacts his local Citizens Advice Bureau for some advice that is specific to his situation. There is a factsheet available from their AdviceGuide website at http://www.adviceguide.org.uk/f_ending_a... but it may be a bit too general.

    Note that the husband should not obstruct the wife from removing her possessions from the house.

  7. No, she can't make a claim on his house after such a short time.  If it is in his name and she has made no contribution to the mortgage, then she has no rights at all.

  9. Your friend has every right to make a claim on her husband of 7 weeks property, but this does not imply shes gonna get a penny. Her name was never on the mortgage nor was she married long enough to collect any assets. Many people act before they think, especially when their bitter & drama has just unfolded. I  advise that your friend moves on with her life & maybe she should consider purchasing her own home?
