my husband had s*x with a friend of his one time and got her pregnant. after she gave birth, she asked my husband to sign her son's birth certificate and he later found out that the woman was going to this fertility clinic for the past 6 years and he had no idea about it. my husband then received a call from a doctor telling him that the woman was pregnant again. he found out that the woman was undergoing artificial insemination from the beginning. can she file for child support from my husband eventhough he had no idea what the woman did?

  1. She can file for child support for the child that they conceived "naturally" as in through intercourse . . . even if she was on fertility meds.

If she conceived the other child using donor sperm . . . then it has nothing to do with your husband.

    Good luck!

PS - I hate to say this . . . but NO reputable clinic would let some woman bring in a sample and just use it.  I did 6 IUIs and 1 IVF cycle - my husband had to show up at the lab to either contribute his sample or bring it in, he had to show ID and he had to sign legal documentation stating that it was his.  I was not allowed to bring it in unless I had donor sperm shipped with proper documentation.

She would NOT be able to collect it at home unless she had him ejaculate into a cup or a "specialized condom" that could not be mistaken a regular condom . . . sounds like your husband is playing games with you and will have to pay up.  It sounds as if he WILLINGLY gave her a sample . . . and as a known donor with no paperwork stating that he will not be responsible for the child . . . he is stuck.

Another thing we had to do was if DH's sample was to be cryo-frozen or if our eggs / embryos were to be cryo-frozen we had to fill out another stack of paperwork about what would happen if we were not together, what would happen if one of us should die . . . etc . . .

It is also a VIOLATION of her privacy for the doctor to have called your husband . . . unless he is somehow a patient, too.

I would call your husband on it because someone is lying . . . and my feeling is that although this women may have been deceptive . . . your husband is somehow involved and not telling you the whole truth, either.  Sorry.

  2. If this is your husband's child from having s*x with her, then yes, of course she can.  If she took his sperm from when they had s*x and put it up in herself, then yes she can still file for child support.

If she got pregnant from artificial insemination and the child is not his, then no... UNLESS he signed the birth certificate.  He would have had to sign papers, since they are not married, saying he knew that he would be liable for child support, among other things.

He should know better than to sign a birth certificate without a paternity test... and he should have known better than to have s*x without using a condom... and personally, if I were a man I would take the used condom with me afterwards too.  I read a question on here about a girl who wanted to know if you can get pregnant if you took the s***n out of a condom and put it up inside yourself...

    Some people are just disturbed.
