Can a woman who's just given birth be evicted?

This woman has promised over and over to pay rent, and never has. She just gave birth, and it appears she'll be down for some time and unable to go to work. My aunt can't afford to lose that much rent. Can she evict a woman with a newborn (by the way-she checked and she'll qualify for an open rent assisted apartment, just not as nice as my aunt's house).

  1. yes she can evict her. if you go to a regular apartment complex they will not care what is going on, they want there money. don't get me wrong i feel bad for the women but its not your aunts responsibility to take care of her and try to help her out. your aunt has been nice enough, if she can get assistiance i would let her know she needs to pay asap or she will be forced to evict her.  


  2. She should have started the process the first time the woman was late on rent. Of course, she can be evicted. It might be best to use a lawyer, as she might not be able to look the woman in the face in court and say "get out."

  3. Sure, having children does not entitle her to demand support from her landlord.   It will have no bearing at all.

    Check your state's landlord/tenant laws and serve her with the proper Notice to (Pay) or Quit, as it varies by state.

    If she has not paid per the Notice, then file for eviction.


  5. If she hasn't paid her rent tell your aunt to serve her with a 3 day pay or quit (and don't accept any money from her even if she tries to pay) then once the 3 days is up your aunt can legally evict her.
