Can an 17.9 year old adoptee be un-adopted?

    Adoptions can be "failed" via the adoptive parents while the child is a minor.  I am not certain if there are any time limits (i.e., if they've had the child for over a certain amount of time, it cannot be done.)  This would unseal the record.  In fact, it would reinstate the original birth certificate as the previously adopted person's only legal birth certificate.  

    Upon reaching the age of majority, a person's adoption cannot normally be nullified, outside of being adopted by someone else.  An adult adoption, however, will not unseal the original birth certificate.  It will, however, seal the birth certificate with which the person grew up.  Then, the person will have two sealed birth certificates, and a second amended one.  Crazy, huh?

    It's very rare that an adoption can be nullified once the adopted person reaches the age of majority.  Fraud must be proved.  I've only heard of one case where someone has been able to have his adoption nullified.  It was, indeed, because the adoption was fraudulent.

  5. It is possible in quite a few states to undo an adoption.  in Calif it is called a set aside.  The adoptive parents need to be able to establish that they were not given accurate and reliable about the child before they did the adoption.  This only works until child is 18, by the way.

I believe you can disrupt an adoption up to the age of 18.  I've thought of this a lot, myself.  I live in an open records state, but if my kids wanted to not be legally tied to me, or if they wanted to have all their information legally reverted back to the way it was at birth (for whatever reason), I would be happy to do so.  I'm not big on the whole "legal ties" bull anyway.  I HATED marriage until I met my husband.  I don't need no stinking piece of paper to tell me who I love!  ;-)

  7. By un-adopted, do you mean emancipated?   I think that in states with sealed records, it doesn't matter the age of the adoptee.  Not sure.

  8. To get "unadopted" they can get their natural mother or father to adopt them back.  That is how my son did it.   Then, yes, there are instances of judges then giving access to the OBC in that case.

    Has this 17.9 yr old adoptee reunited yet?

    Or, are they in a state where they can petition for their OBC when they turn 18?  

  9. As far as I knew - adoption was a life sentence!!

    Even if they got re-adopted - yet another birth certificate would be issued - but I doubt you'd get hold of the original.

    I hope that you will think very carefully about where you are choosing to spend your time and who you're listening to w/r/t adoption.

    When people so unwell that they compare adoption to a prison sentence choose to spew that sort of hate on the internet, it is important that we protect children from it.

    If you are having trouble at home, seek out some peer counseling and try to work through it. This is no place for any minor to turn from advice.
