Can an Illegal who is mother to a US citizen get citizenship without leaving the country

This is complicated, and made me change my mind about Immigration Amnesty laws. An acquaintance of mine was born and raised in America, so she thought, but when she was 17 about to graduate and asked her parents about her social to get a job, they dropped a bomb on her. That she was brought over here at age three. Well 6 years later she is still here, and has 2 year old little girl with an American, who doesn't want to be a dad and skipped state. She knows NOTHING of Mexico and is scared to go there especially with no family there (she has legal uncles and aunts here) and now she has a little girl to worry about. Is there anyway that anyone knows of for her to work on her citizenship whithout being deported. I have read that many get into the military, illegally and gain a greencard/visa. Can anyone provide us with a recruiter that is sympathetic towards this cause, or any lawyers who work for free on cases like these. I know they are out there, where does she turn with no money or family thats willing to help?

And for the wise rude comments that I am sure I will get, have a heart could you imagine how you would feel in her situation, she isn't mexican she was raised American, and Lord knows what will happen to her in Mexico talking like a preppy white girl..... and much less her daughter. Its her parents that are the culprits here. And God Bless her for wanting to join the military just to become the American that she thought she was all along! At least she won't take being an American for granted like the rest of us, if she can get though this!

  1. 17 with an illegitimate baby. Sounds like a mexican to me. Yea, she should join the military. Ugh

    I never take my country for granted and neither do the people defending it, at home and abroad.

It does not help matters at all to talk to you as you wish to be talked too... she is not a citizen, and the child's citizenship follows the mother.  You seem to be asking for an illegal process and you should not do that.  Mr. Bush is now supporting people who come forward and tell us they are illegal aliens.  With legal Uncles and Aunts, she can go to Mexico and receive family support and that is as it should be done.  Even if she does go into the military, her child is still and illegal alien and there is a problem there to deal with.

    On top of all this, Mexico is a corrupt country, but you can live well there.  If she has an education and goes, she should be able to find work and a job very quickly.  The Mexican People can live very well with an education and that IS as it should be done.

  4. Unfortunately, she cannot apply for a Green card (or citizenship) because her child is a USA citizen. When her daughter is 21, then she can petition for her mother.

    What about your friend's parents? What is their immigrant status in the USA?

  5. under the constitution of america, any child born in the U.S is automatically a citezen. The parent can't be forced to leave the child, so i would imagine that the parent would be granted citezenship as well

  6. Let me saw that I do not condone or support illegal immigration in any way.  (But those parents...........)  Here is some information though.

    The National Defense Authorization Act (NDAA) of 2006, that authorizes the enlistment of \

    (1) nationals of the United States;

    (2) aliens who have been lawfully admitted for permanent residence (green card);

    (3) residents of several former U.S. territories; and

    (4) any other person “if the Secretary of Defense determines that such enlistment is vital to the national interest.”

    Please be aware that the military has no special wand, and only forwards the application.  It can still be denied due to the illegal residency. (Long shot)

    Has she considered Canada?

    Applying for a university student visa?

    Applying for a work visa?

    Nothing against Mexico, but if I had to live somewhere for a couple of months while I fixed my citizenship....

      

  7. How can her mom be a citizen and her not? If you apply for citizenship you can file for your children as dependents to you and they get citizenship as well or at least permanent residency status.

    Knowing mothers it would have been impossible for her mom to just suddenly forget she had a child and not list her as a dependent.

    But considering she her mother is a citizen and she is still under 21 her mother can petition her. It just take time.

  8. joining the military just to get a greencard/visa is a really really dumb idea

    especially considering the fact that she has a baby

    and she probably wont get deported because of her baby and if she's worried, just get her married on paper with some american

    they dont have to even see eachother

    just pay the guy a little dough and get him to sign a paper saying that the two of them are married

    in a year or two after being married, she will become a citizen and you can get a divorce, on paper

  9. Sometimes yeah under a hardship waiver. First the illegal must turn themselves in and go through the process, that isn't guaranteed acceptance.

  10. There is no getting around it.  She is an illegal alien and does need to go home to her own country before anything legal can be done to straighten out her situation.  

    She knew she was illegal BEFORE she had the child so she basically did the same thing her parents did to her.  

    She could always go back to her own country with or without the child.  She cannot get into the service if she is illegal.  

    One cannot become legal starting out illegal.  She will never amount to anything in this country.

    She is subject to deportation at any time.  Best she make plans now to depart on her own.

  11. No,she will have to go back to mexico or face deportation and a 10 year ban if she is caught here.
