Can an abuser take custody over a child? ?

Hello, I been wondering if an abuser can take away a child from a mother by telling the court that the wife cheated on her. And he has the evidence that she did. It will be great-full if any of you can give me any information. Thank you

  1. The only why that the court will give then custody is if the see you unfit . And most of the time it has to be really bad . The courts look at who baths ,feeds and does all the child's care . You have nothing to worry about . Contact your legal aid office and ask for a copy of the law on child custody .  


  2. Extremely unlikely. Adultery doesnt necessarly classify someone as unfit nor is it an endangerment directly to the child. All the evidence on adultery wont chnage the Judges mind, so this would never happen. Now if it was child abuse and/or drug/mental abuse then it would be a different story so the mother has absolutely nothing to worry about here

  3. well i'm not sure... if the abuser gets custody, then you can file again for abusive behavior-thing... i'm not really an expert on it but i don't think an abuser can take a child away from a nonthreatening home.... idk.  

  4. I think that the court could care less about you cheating true or not over him being an abuser.
