I wouldnt think it would be any different than riding in the back of a pick-up truck.

  1. It depends on your state, if the cargo area is enclosed, and sometimes other conditions.

For example: Georgia, yes,  people 18 and older; people 17 and younger in pickup trucks with covered cargo areas; any pickup truck off the interstate

Visit the following site for laws regarding legality of riding in cargo areas for your state.:http://www.iihs.org/laws/cargoAreas.aspx

  2. Legally NO

And ridding the back of a pick-up is also illegal(if it's not specified otherwise)

  3. In a pickup truck they can but in an suv no and it sounds dumb but that is the law in your state, the suv is enclosed so seat-belts are required for all passengers and if a seat is not present then if will be illegal.

  4. NO

  5. both are illegal.

back in my day it was totally legal.  heck it was totally legal for my uncle to load up all of us kids on his flatbed hay truck that has no sides and take us to the beach.  ahh the good old days before idiots and lawyers ruined everything
