Can an employer base review and raises on overtime

I am a salaried employee and my boss is always saying and throwing hints that when people work only the 40 hrs they are required they should not get more money. Today she told my co-worker that she bases her reviews for raises on amount of overtime put in (which we do not get paid for because we are salaried). Can an employer do that? especially when I have many added responsibilities, but I am a fast worker and I manage my time very well.

I would appreciate answers from HR Professionals and people with knowledge of labor laws.

  1. An employer can base raise on anyting they want unless is is related t s*x, race, etc.

    My last job if you were not doing 60 hours a week you were let go.

    How about asking for more work so you can put in more hours?


  2. I am in HR.  Reviews are based on a number of different things, but start with do you meet and/or exceed the responsibilities within your job description.  It is not appropriate to be basing reviews or compensation increases on only if you work greater than 40 hrs.  

    Salaried employees working more than 40 hrs happens from time to time but is not a job requirment therefore, not something a raise should be based upon.

    I hope this helps.  My suggestion would be to take this to your in house HR and talk to them.

  3. An employer can base the employee's review and raise on anything concerning that employee's performance or lack thereof. Since working overtime falls into this category, then it can be included.

  4. I work 70 hours a week.  If I switched to 40 hours, I would be fired in a month.

    You are a salary employee, you do NOT have a set number of hours a month.  If you do not like your job, stop whining and get a new one.

  5. yes, your corporation is paying you to do whatever you can to advance their interests, workers should be doing whatever they can for their corporations even without raises, raises should only come when you work your way into management, serve your corporations and you will rise
