Question:

Can an employer deny you for a job because of your mental health?

I applied to be a corrections officer and will have to take a psychological test soon. I do have a disorder, but it doesnt get in the way with how i work or my life. Can they deny me a job just because of my mental health, although it doesnt effect my work?

  1. I don't know for sure, but I would think no because that would be discrimination. However, if they can make a case that it would impair your decision-making capabilities as a corrections officer then maybe.


  2. High stress can enhance or bring on mental illness...  maybe you should reconsider and not take a high stress job?  

  3. If you're correct and it doesn't affect your work, then no. If they do so, it would be illegal discrimination.

  4. They will deny you employment, only they will not say its because of your disorder. They will say its something else.  

  5. The employer (not you) has the privilege of deciding whether or not the disorder is relevant to the job function. Afterall - you've never done the actual job, so they would be the party in the position to decide. That being said, they may not care.  

  6. I would not tell them about your disorder,unless they ask you.  If you do tell them about your disorder, you will most likely get a letter in the mail thanking you for your interest in the position, but they have filled the position.  I am sure it would be discrimination if they did not hire you because you tell them you have a disorder, but they most likely would choose someone else.  It's not right, but it happens all the time.

  7. If you are in an "At will" state, they can hire you and fire you without giving any reason whatsoever. Since most states are "At Will" employment states, I would say it's a good bet that the answer is yes.
