  1. Usually Holiday is paid if you are employed when it is due. PTO on the other hand is earned. It doesn't sound right, though it may be in the contract.

    It could be a simple mistake. Contact the Human Resources department and ask them. It may have been an error. I offered a 3 week notice from a company. they waived it, but didn't pay my unused vacation. I spoke with HR and told them my supervisor waived the notice requirement and they sent me the check.  


  2. Depends on where you are, and whether you have a contract that says othewise.  It would be unusual for a company to do that, but not necessarily illegal.
