I resigned from a job to take a new job. The resignation was due to the fact that I was under investigation, knew I was guilty and to keep my record stellar, I resigned upon their advice. My attorney requested my record, and there is nothing in my record to indicate any type of investigation. The person who was investigating my case is now head of HR and knows the situation. Is he allowed to divulge information that is NOT in my record/personnel file or are there confidentiality rules that apply. I'm in OH.

  1. I"d say the one way they would have the legal obbligation would be if it went to court and was given a summons to appear? dunno know for sure other wise..

  2. most companies these days do not "black ball" former employees because they fear legal action if they do so...the company I work for does not divulge any information (good or bad) just the dates of employment
