Can an employer sue an employee?

I got married 2 years ago and during this time we had an aparment. We got divorced a short time later and in our divorce agreement we were responsible for our own debts in our own names. I had alot of debt in my name because my ex didn't have good credit and I did. But, also, because we ended our lease early we were charges some money by the leasing office. I paid half and my ex was suppose to pay half. He didn't and a judgement was sent out against us. Well, they could never find him so, they took wage garnishments out on me. We do not have a payroll at our office so, the sheriff told me to mail the paperwork to our HR. I did and nothing ever came of it. A year later the company came back wanting wage garnishments and I filed bankruptcy. But, now they're going after my company because the garnishment never happened. My HR is threatening to fire me if they get sued and also said that they would sue me for the money. Is this legal?

  1. Yes they can sue you for damages.

    But you should be filing a class action law suit against your ex in return if you get sued and for lost wages that were garnished from you because of your ex.


  2. Your HR person, the one who did not follow through with the wage garnishment is the one who is going to loose thier job - not you.

  3. Sue you for what, exactly?  On what grounds?  Seems to me like if they garnish your wages, that's it.  Unfortunately you got stuck in a bad situation and yes, you do have to legally pay the money, but whether or not that has to come to a lawsuit is up to you.
