Can an illegal immigrant collect Child support for a daughter born in the U.S.?

She purposely got preganant by an american so that she wouldn't get deported.

  1. the fact is a baby born here to an illegal can recieve social security for the baby. child support is payed by the father either dirrectly or by court declaired deduction from his wage. If she declaires she doesn't know who he is etc they get social security. I feel We need to repeal the allowing of children born to illegals to be citizens emediatly.

    1. If she is in the US she would need to prove that the person is actually the father of the child.

    2. If she is not in the US it would appear likely.

  4. Yes, she can collect child support, that does not mean that she will not get deported. As for her getting pregnant on purpose, you know it takes two to tango as they speak- he is just as responsible for it as she is (should have used protection.)

  5. The citizen can file an affidavit with the court stating the immigration fraud committed by the illegal. He can also petition for the child and gain custody. He needs to get an attorney

    If the child was born in the US she can petition for the child support. So the court is not based on the fact she is illegal but that the child is US born

  7. The father should be supporting his child. The child is the only innocent.  Whether she can or will be able to go through the courts should be irrelevant.  If he is any man at all -- he should pay.  If she gets deported, he should pay too.

  8. Regardless of whether or not she is illegal (although having a baby will not guarantee her immunity from deportation) is beside the fact. The father is responsible for paying child support while in the custody of the mother - whether she lives here or somewhere overseas.

    Furthermore, the father (or mother - whichever party does not have primary custody) should understand that the mother's actions has absolutely NOTHING to do with the child. Denying the child support is punishment when the child did nothing wrong.
