Can an ny state empoyer withhold tips ?

i work in a fast food restaurant where there is a tip jar. The manger has been saying since Jan he was going to give them out to the employees but never does.. Is this legal ?

Tip jars don't belong in fast food resturants.  Specially when most teenagers who work there don't get customer requests correct.
