Can anyone cite any particular cases of the FOREIGN INTELLIGENCE SURVEILLANCE ACT and how the 4th was broken?

specifically, anyone who they had zero probable cause for investigation... and how the FIA decided to tap that particular person in the first place?

  1. Actually, there is a whole procedure, even under the Patriot Act they still had to get a warrant to continue to perform surveillance on someone. Right now, with PC, you can start to perform surveillance on someone but unless the FISA court OK's a warrant, all info gathered is gone and you are no longer allowed to continue watching that person or group. The Bush administration tried to be allowed to do this without the FISA court in a new add on to the Patriot Act, they did not get it and even if they did I am pretty confident that once a case like that went to the Supreme Court it would be struck down. Say what you want about the Court it is pretty pro-liberty on an individual basis. The whole idea that you can be listended to for no reason is a myth, however, it is only a myth because people have been keeping it in check and it has not been the ACLU, it has actually been several smaller Civil Rights Groups, the ABA and yes, as much as I am shocked to see it, people in Congress-can't believe they are doing what they are supposed to do!, shocking really! ;-)
