Question:

Can anyone help me with a Motor Vehicle Title question?

1. Car was purchased in January.

2. Dealership failed to send the Tag Information after 3 or 4 months.

3. Finance Company has NO records of the Title.

4. A Title was issued DIRECTLY to the person applying.

Therefore, it would seem like the vehicle's owners actually own the vehicle correct? How does the Finance Company stand without having a Title. Should the owners continue to pay on the vehicle? Should they get an attorney/lawyer? (if so what kind)

(Additional Information the vehicle owners live in Atlanta, Georgia.)

  1. A similiar situation happened to my grandmother. There was still a contract signed and payments should still be made. The dealership is at fault but only for being unreliable and not sending the stuff to the finance company and to the DMV. An attorney would be a waste of money even if you could find someone to represent you. The finance company could prove how many payments have been made and the owners would have to prove they made all the payments that the contract specified.


  2. Finance company stands awkwardly.  They have an unsecured loan.

    Yes, morally, the owners need to continue paying on the vehicle.  If they don't, the finance company IS going to come after them for the debt, and will win in court, even if they can't reposess the car.  So they'll garnish your wages forever.

    Don't try stealing the money from the finance company, just because someone messed up the title application.  

    Do the right thing.  Even when no one is looking.

  3. If you have the title (pink slip) you are the legal owner. The finance co. still has a lien on the vehicle so you must pay. The title is usually held by the seller and is held as colateral. The finace co. can and will come after you.

  4. If The title is in the name of say,  John and Mary, then John and Mary own the car and also may have the title in their hands but that does not mean that the loan company does not have lien on the car.    The title should state who the lienholder, if any, is.  Try missing a payment and I am sure they will hear from the loan company very fast

  5. If the car was purchased (from a used car dealer I assume) and the dealer did not produce the title within 30 days, the buyer can return the vehicle for a full refund if the vehicle is in the same condiiton.

    Are you saying that there's no lien on the title and you're wanting to know if you own the vehicle outright if you are listed on the title without a lien?  More info, pls.
