  1. With a search warrant, you can search the premises specifically stated in the search warrant. If the search warrant specify that a stolen car is within the premises therefore they will only have to inspect the garage and outside facade of the house.

    A search warrant do not give the police officers a warrant to search the whole house, unless the police have enough intelligence that the persons or property is hidden underneath the house or above the house.


  2. You secure the scene and any persons in that scene.  Then you search everything you can within the restraints of the warrant looking for the evidence listed on the warrant.

    In other words, if you are looking for drugs you can search ANYTHING.  If you are looking for a bicycle you can't look in the fridge, cupboards, etc. because a reasonable person would know that a bicycle can't be hidden in a dresser drawer.

    Even while looking for that hypothetical bicycle, anything seen during the scope of the search not covered by the warrant can also be taken as evidence, as long as the officer did not need to manipulate the scene to find it (plain view).

  5. Assuming a search warrant is signed by a judge: An officer is allowed to search for items described on the warrant and in places that would reasonably hide those items. An example might be, if you were searching for an elephant you could not look under the bed. If on the other hand you were looking for drugs, well not many places would be off limits. Drugs can be hidden anywhere. In most cases if you came accross items that were not expected, a dead body lets say. The scene would be frozen, or secured and another warrant would be written that was specific to the crime of murder and items associated with that. Hope that helps.

  6. How do you physically conduct the search?  I guess the best answer is methodically and systematically to ensure you don’t miss anything. I dont think thats the answer you were looking for.

    ( Is the warrant a no knock warrant? ) ( A copy of the warrant and a receipt of the items taken from the property has to be left with the property owner ) What exactly are you looking for?

Once you've got the search warrant, you go to the location with a team of officers.  Some take positions outside the building, making sure they can catche who or what falls out.  A SW entry team goes in and "freezes" everything and everybody so that the SW execution team will go in and find everybody and everything looking as it ghad when the SW was 1st executed.  Then the execution team goes and makes sure it knows where to look for contraband.
