Can anyone tell me how long can one get an Affidavit in lieu of a certificate of legal capacity to marry?

Me and my fiance are planning to get married. Am wondering how long is the processing of this affidavit. Will it just take one day or weeks? Hope you guys can enlighten me. Thank you very much

  1. An affidavit is merely a statement that you type up and swear to before a Notary Public under pains and penalties of perjury that it is true.

    You present it to the Clerk in lieu of your birth certificate or other confirmation of age.  Unless you're being asked to present someone else's affidavit, it should take no time a all.  If you're being required to file an affidavit you have to obtain from someone else, it's only going to take the time you will need to acquire it from that person or institution.

    Also, some cities will accept a baptismal certificate from your church as proof of age.


  2. an affidavit and a certificate of legal capacity to marry? are 2 different things not to be confused , you must get a legal capacity to marry if you want your marriage to be legal and recognized by the law. in both countries.

  3. an affidavit by definition is simply a contract signed under penalties of perjury in Front of two witnesses, preferably a notary public.  Write up your affidavit to meet your specifications, sign it in front of a notary and have them notarize it.  Two copies.  One of the copies is for your records.  Take the other copy to the closest superior court and have it recorded with the clerk of the court as public record.  Anything recorded as public record is admissible in a court of law as evidence.  The whole process should cost less than $50 and take the better part of a day.  Good luck, I hope this helps
