Can anyone tell me what to expect when going to bankruptcy court in nj for filing a ch 7?

  1. You should hire a lawyer i think with all those new bankrupty laws.


  2. Some of the creditors/collection agecies might be there or

    not. You will plead your case, the judge will ask you a few

    questions how you got into debt it would be good if you had

    any ofthe following, loss of job for long period of time, illness,

    extreme medical expenses, and if anybody came from

    the creditors side lawyer will plead their case, now in case

    just in case they dont get all the debt dismissed, ask for

    dismissal of all interest fees added on to, lawyers fees from

    them, overlimit fees and most of the time the judge will

    accept but if there isno income, job or assets to make the

    payments, the judge will give a judgement until you do have

    a job but most of the time it doesnt go anywhere, maybe a

    lien on property, but allthatmeans isthat when youre ready to

    sell your home they might askfor the money then thru your

    mortgage.  You will start fresh trying to rebuild your credit

    for 10 yrs. Get educated about credit cards, in credit boards.

  3. If you are asking about your actual "court" appearance there is not much to worry about as long as you are truthful.

    It is not court like you would expect.  You are actually in a room with dozens of other people in the same situation as you.  The Trustee(who is the one who is overseeing your BK) will call you up.   They will ask you if you listed everything to the best of you knowledge.  They may or may not have a few questions past that for you.  You probably will be done in about 5-10 minutes.  Do not worry about any creditors showing up, unless you have a lot of assests they won't bother.

    If everything is fine in about 60 days you will get your discharge.  If the trustee wants additional information he will let you know and your attorney can help you with that.
