Can business owners keep employee tips?

There is a small coffee/crepe shop in my town and the girl who works the register and makes the food said that the business owner keeps the tips from the credit card receipts and the tip jar. Is this legal, specifically in Texas?

If they are paying above minimum wage it is. If they are paying waiters or waitress salary then no.
