    The unit will not be sponsored directly by the school; the PTO or a committee of concerned parents can charter the unit. The previous poster is correct; for the best information, contact your local Council; they will get you the information you need to charter a unit at the school.

In general, yes.  However, there are different guidelines that may be imposed by the legislation which allowed the charter schools in your state, and your best bet is to check with the local BSA council - they'll be able to answer your question with appropriate authority.  To locate the local council, go here:

    http://www.scouting.org/media/lcl.aspx

    and enter your ZIP code; it will produce the council name and telephone number.  Give them a call - it'll be worth your time.
