Can child support agreement be renewed?

I have a legal agreement to pay my deceased husbands child support and alimony arrears to his ex-wife until her death. At that time any interest she had in his estate reverts back to me and the case against me has been dismissed with prejudice. Can a court overturn this? The woman is 79 and the "children" are 50-60 years old.

Sounds like your husband stiffed his ex-wife and his estate owes her.  I could see some legal basis for overturning the ruling, but not necessarily so.

That is not child support.  Usually alimony ends at death and you would only owe arrearages from his estate.  I would say you should consult an attorney.  This is not child support and sounds like extortion.

well i dont understand how his wife and his situation is all under you child suort order.... if they were married when he gained custody of the children then I could see that but how the heck is his alimony any of your responsiblity??? I would call a specialist on that one

It seems very strange that your husband was still paying child support to "children" of such an advanced age.  Are you sure that those payments were classified as child support under a child support agreement?

If so, it should be easy to terminate the child support agreement with a visit to the court.  Child support payments can be terminated in court once a child has reached the age of majority (18 or 21), which these people have more than surpassed.  However, you *must* visit a court to terminate the agreement-- just ceasing to pay can result in unwanted financial and legal complications.

I would think that it would be highly unlikely that a court would force you to make payments to any of these people, unless there was some restrictive clause about it in your husband's will.
