Can creditors come after you after 11 years, I live in california, can they file a judgment after 11 years?

Live in california and recived an collection letter and they are asking for payment + Interest after 11 years? Can someone tells me whats the "SOL" time frame in state of California? Is it 4 years or 7 and if thats true ..Can they still file a judment againts me?

  1. The statue of limitations is determined by each state.  As for being out of SOL - they can still attempt to collect and try for a judgement... if you go to court and argue it is out of SOL - you will win.... if you don't show they will get their judgement.


  2. From what I can find, it is 4 years. So send them a letter back telling them to cease any further communication. If they try to sue you, it's outside SOL if you have not paid anything in 4 years.

  3. This is ancient debt that's WAY outside the SOL. They have no power over you whatsoever.

    Send them a letter via Certified Mail + Return Receipt stating:

    Per the Fair Debt Collection Practices Act, I am requesting that you:

    - Cease all verbal communications with me about this alleged debt.

    - Provide written validation of this alleged debt and that said alleged debt is within the statute of limitations

  4. The statute of limitations is 4 years .  They cannot file suit against you after 4 years.  You can tell them to F*** off.  These are essentially scams.   There are also a lot of collection scams going around everywhere for debts that were never incurred.
