Question:

Can creditors still sue me for fraud if I've filed for bankruptcy because I can't afford to pay them anymore?

I've been paying them through my checking account, now I've closed it. Some kind of legal person called me and told me that bankruptcy can't stop the lawsuit.

  1. I don't know if they can still file a lawsuit.  What I do know is that when they call if you tell them that you have filed for bankruptcy and give them your lawyer information it is illegal for them to continue to call you.  They are supposed to remove your contact information from their system and replace it with your lawyer's information.  If they continue to call it is YOU who has the right to file a lawsuit against them.  I know this because I've worked in collections and I know the law.


  2. It will be stopped if you named the creditor in your bankruptcy, and your attorney has sent the collection companies letters of notice of the bankruptcy. Once they receive it, they are not allowed to contact you. Companies hire people to intimidate the card holders to get what they can by threatening a person. It is illegal for collection agencies to do this.
