Question:

Can credits go after foreign spouse? Will it affect her U.S visa?

I'm probably about to call up my creditors and threaten them with situational immunity ( I have no assets, 3 years from statute of limitations, head of house hold, can't garnish my wages or bank account) and try to strike up a deal to cut my debt by 30%-50% if I pay the whole thing at once.

I just came back from living overseas where I met and lived with my wife for 8 or so years. We're waiting on her visa while I get this stuff cleared up. Will the creditors be able to go after her foreign property or sue her? Will my actions affect her chances of getting a U.S visa/greencard?

Please provide sources.

  1. Your financial situation in regards to debt won't have any impact on her immigration dealings. As long as you make enough to meet the support requirements, you're ok.

A credit agency in the US won't be able to take assets that are in your wife's name, but I am not sure about joint assets that have both your names on them.
