Can dad file contempt charges?

Dad had a visit with his kids today. He has been in an almost 2 year long visitation battle with mom. mom got a restraining order against dad over a verbal fight dad got into with his wife while the kids were there, although mom waited 8 months after the incident to file any paperwork and withheld kids from father for that time also. Father got visitations back but restraining order is mutal restraints and still in effect. Now today dad had a visit in the order it states mom is to drop children off and leave immediately, this visit mom stayed and refused to leave, now she was in violation of the restraining order but dad did not call cops cuz he didnt want to scare the kids,but can dad file contempt charges against mom for violation of agreement since she stayed at the visit. Father has pictures of mom and daughter layin on grass and playin during his visitation time.

  1. From a lawyer.  It's technically a violation of the visitation orders but it's a very minor violation and it will show a mother playing with her children.  You need to pick your fights and only go on those you know you can win and get some results.  Judges don't like minor things like this taking up their time.  Wait until you get something good before going to the judge.
