Question:

Can defendant appeal a case even if he wins?

I was suing my past landlord in California for not returning my security deposit($1000). I lost my case and I owe the defendant almost $450.

Here are my questions.

1. I 'm worried that the defendant may appeal even if he wins.

What would happen If I pay for the $450?

2. Can I appeal a case? If so how?

Thank you.

  1. No, that settlement should end the claims he has made, so once you pay the $450.00 it is settled and he can't make any further claims unless it's a new issue.

  2. No, he can't appeal, but he could sue you in retaliation for legal fees or other costs associated with defending the lawsuit. You could likely appeal the decision, but it all depends on the court that heard the case in the first place.
