Can this seller that i won a phone on ebay and i cant pay the item due to unability to make my sending rates more to pay for it. So now he send me a message asking what state do you live in and city and blah and i just asked can we just agree not to pay and he said i can sue you through small claims and i asked if i can have a couple days to see if i can find out how to pay.

  1. He can try, but if he doesnt have your contact info, the worst that he can do is leave negative feedback.


  2. Yes he can sue you. He does not need to get your contact information through you. Infact, he can just subpoena the information directly from ebay. They will be required to give it to him, under order of the court. I hate be the bearer of bad news, but when you put in a bid, you entered into a contract. By not paying, you breached the contract. He can legally sue you. Also, he can legally, place this breach of contract on your credit report.

  3. He will sue you and you will get whatever you paid for.

    Shouldnt bid on items if you cant pay for them but he would have to come serve you in your state which is going to take time and money so he should just drop it.

  4. Probably just a threat.  First, if you are a minor he can't sue you because there is no contract.  Second - it would probably cost him more to sue than the price of the phone.
