Can he travel out of the US?

my partners 5 year old son lives with his mum in USA. she flew out there to marry a US citizen in sept 06 and her son flew out to live with her shortly after. she has recieved her green card and is free to travel back to the UK without any problems. she has told us that Harry cant come over for our wedding in august as his paperwork isnt through.

isnt it possible for him to travel on the visa that he has?

we dont know if she is telling the truth or just trying to be difficult as she doesnt want us to get married!

  2. The boy, presumably, is  British citizen in the US, and as such, can fly out any time he wishes.

    With his Mom now having her green card, and presumably married to this American you mentioned, the boy would not have any problems in reentering the US after the wedding.

    In short, she is lying.

  3. Even if he had a visa that was still technically valid, he couldn't use it, as he's now in the process of becoming an immigrant. If he did leave without permission, he would legally abandon his adjustment request and wouldn't be able to return without a new immigrant visa. However, it is possible to ask for permission under Advance Parole with USCIS. If the mom applies for it, and receives it before they depart, it wouldn't foul up his pending immigration status at all.

  4. If the child is in the middle of adjustment of status proceedings, and if he travels outside the U.S. without first securing an advanced parole form, the application for adjustment of status will be considered abandoned.

    So, it's 100% possible that what she says is true. Harry can't use the visa in his passport because it doesn't match what would be his purpose and intent upon his return from the wedding trip. Your friend may have a history of being difficult, but this time her excuse has the ring of truth to it.
