Once we have consent to treat, we can run a number of diagnostic tests to determine how best to treat you.  One such test may include testing for drugs or alcohol.  We have to know what you've got "on board" before we can administer certain drugs, and also to determine if that may be a contributing cause of your current problem.  For example, if you are behaving abnormally, we need to find the cause: head injury, diabetic hypoglycemia, infection, alcohol or drug use, or something else.

    However, as others have stated, this is confidential information and cannot be released to others except in certain situations.  For example, your employer may be entitled to these records if your emergency was caused by a workplace accident.

    However, your hospital records are private...your employer can't access them, and the police would need a court order to access them.  Furthermore, for the most part....no one cares if you are using drugs.  Certainly the personel at the hospital don't care, at least not beyond establishing the reason for an immediate health concern.

  6. Yes, I work in a trauma center, and when you come in with a traumatic accident a urinalysis is automatically done.  Your consent is not needed.

  9. As the nurse said, anyone brought in from a trauma would automatically have a drug test.  But, as someone else mentioned, the police need a warrant to access it, and anyone else would need your direct permission.

    HOWEVER, if you are using anything recreationally, you need to report it to the doc.  A lot of meds, otc, or illegal drugs used can interact with other medications they may give you.  Or may be the cause of certain symptoms that the docs are trying to treat as an illness.

    It is very important that you are honest with your doctor about any recreational drug use.  You also need to make sure they are aware of any otc and rx meds you are using.

Another is the "reasonable man rule" that assumes the incompetent would give permission if they were competent. The courts, realizing the hospital's difficult position, generally give wide latitude for a short period of time for hospitals to act in this regard.
