Can i be evicted if rent is one day late?

to beagle, 25.00 a day late fee. i moved out on the 10th because she was harrassing me going in and out of the mail box, making racial remarks and frankly i believe she will win. she says she has the right by arizona law to do everything she has

  1. She cannot evict you unless you receive a formal eviction notice. Did you get one of these?  You told me you received one on July 2 and yet you had until July 3 to pay your rent. As I said, there is something very fishy about that.   Perhaps the July 2 notice was just an advisement letting you know what could happen but she still should not have given it to you.  I assume that you are being charged $25 per day for everyday you haven't paid the rent.   I still believe that she has an obligation to give you something like a 5 and 10. A notice saying you have 5 days to pay up and if not done then 10 days to clear out. In total it is 10 days from the time you get the notice.  If you have been evicted then I cannot see how you would be responsible for any late fees.  The rent for the time you were there but only for the 10 days of July. Although they may go after you for the balance of July.  You never said who was suing whom. Whether or not they can go after you for the balance of July I don't know. Just because she says she has the authority to do what she's doing doesn't mean she has.

    Going into your mailbox is an invasion of your privacy and your rights.  Racial slurs is a violation of your rights as well.

    When you go to court taken any and all receipts you can: moviing expense receipts, the notice of eviction she gave you on July 2, a copy of the rental agreement and any witnesses that can provide first hand knowledge (not hearsay) evidence of the landlord's conduct.

    Don't assume she is going to win.

  3. If you moved out why do you care about being evicted.  To answer the question anyhow, once they get the rent they can't evict you.

  4. IF you have already moved .... how can she evict you ?  She can't ....

    IF you have a court date ; simply show up and let the judge know that you vacated the property prior to the eviction .... and you should be ok .... especially IF you are paid in full and have all your receipt .
