Can i be refused entry to Canada because of unresolved contract penalties?

My student visa expired, but instead of renewing it, I decided to apply for permanent residency to Canada . As a result i had to leave Canada before the student visa expired (as to not break the law) and leave the apartment i lived in just one month after i had renewed my lease.

The landlord claims i have to pay 3 months (negotiable down to 2) because of me breaking the lease. Nowhere in the contract i signed are stipulated penalties for early termination.

I was never late on rent and I've paid every single month, but the landlord claims he will go to the "Regie du logement" (in Montreal) and file a case there, and that it can prevent me from entering Canada or hurt my chances at immigration.

This is a civil law matter, not criminal, so i was wondering if he was telling the truth, or he's just bullshitting me trying to scare me into paying him 3 months rent.

  1. Actually, if you break a lease, you are liable for the full term of the lease.  That's what a lease is: a binding agreement to pay $X a month for Y months.  Absolutely, he has a right to file.  And absolutely, being a defendant in a lawsuit can affect your immigration application.  And your credit, and your job, etc.

    And student visas are always temporary non-immigrant visas which mandate that you return home upon completion or termination of studies.

    You have really fouled this up.  Pay or you do not play.


  2. ibu guru knows nothing about Canadian emigration. Most of what he says is wrong.

    Emigration to Canada does not check your credit or financial status.

    As long as you do not have any felony or criminal record you are ok to emigrate.
