Can i become a US resident if i have a brother who is a citizen?

I have been living in the USA for 17 years im 18 years i entered this country illegaly at 1 year old can i become a us resident if i have a brother that is a citizen? if so how old does he have to be?

  2. If you live long enough, might be the better answer. Your brother can file an F4 family preference petition for you, if he's over 21 and an American. However, those petitions take a minimum of 11 years before they are valid for use, and if you're Mexican or Filipino, much longer.  They don't provide any benefits or protection for you while you're waiting for the petition to become valid. As the law stands right now, you would not be able to become an immigrant while in the US. You'd have to go home first. What US immigration law will be 11 years from now is anyone's guess, of course. However, if you remain in the US for more than a year after you turn 18, you will be ineligible for any visa, including an immigrant visa, for 10 years unless you're able to get a waiver from USCIS.

  3. Your brother the US citizen may petition you if he meets the financial responsibilty guide lines as well, unfortunatley the waiting process for siblings can be upto 10 ten years before and actual work permit or green card.  The fastes process is through your parents.

    due to the fact you enter U.S without a visa. you are not permitted to stay in USA just because a Green Card is pending.

    Although you have no legal status in the US, because you entered before the age of 18, you can leave before you turn 18 and not incur any entry ban due to illegal presence. If you do not leave before you turn 18, you will have to declare your illegal status to USCIS who will place you in deportation proceedings. Once your ban period is up, your sibling will be able to re-file the petition and it will process as normal.

    If you don't take this brief chance to correct your legal status, you could put yourself in an impossible situation at worst, a lengthy application process with risk of denial at best.
