    There is an implied covenant in every tenancy for quiet and peaceable enjoyment. If the landlord is the cause of the nuisance then I would suggest that there are grounds to explore the possibility of surrendering your tenancy without penalty.

    However the principle of caveat emptor applies when entering into any agreement - you should have looked at your surroundings. It is reasonable to expect a supermarket to take deliveries at any time of the day or night and that taking deliveries will cause noise.
