Can i break my lease within the first 30 days?

i moved in with friends about a week ago (august 1st) and it is really not working. they are nasty slobs and i wanna punch a ***** in her face for keepin on taken my things out of my room. plus the landlord wont fix my shower and my toilet. can i break my lease and get out without having to be sued

  1. Sorry no, not because of a bad roommate. You might want to install a lock on your room's door. The shower and toilet are a different issue. If they are completely unusable and the landlord won't fix them them you may be able to withhold rent until he does, but this involves going to court and get a judge to approve it.

    If you are on the lease you are stuck unless the landlord lets you out, perhaps for some upfront cash he'll remove you from the lease. If you are not on the lease just tell your roommates that it is just not working out. I'd move out first then offer to pay them 2 month's of my share of the rent and let them deal with find a replacement.


  2. roommates are a difficult situation - the lease is not broken if some of the tenants are staying.

    Go talk to the landlord - Landlords will usually let one person leave as long as the remaining tenants can pay the rent.  Just make sure that you are removed from the lease or you will be liable for the rent if they do not pay it.

  3. Put a lock on your Door,  Take pictures of all repairs needed. Write a letter explaining details concerning the work needed and do not forget to date the letter. Make copies of everything, send it to the buildings owner if You can. In the letter state You will notify the City about opening an Escrow account for Your Rent. Do not stop paying Rent.

    Is your name on the Lease? If it is the only way out is if You transfer it to someone else. They must have good credit if they run credit checks. You must let the system work for You, in most states the lease holder has more rights than the landlord only if You play by the rules. Good Luck.

No you cannot, but try to find someone to replace you and change the less to their name.  Second option is to put a lock on your bedroom door.  Send a registered letter to landlord requesting any and all repairs.  Take pictures of the bathroom.  If repairs are not done in 30 days, call your township's building code enforcement agent.

I am a landlord, and when one of the roommates want to take their name off of a lease, it has to be agreeable to the other roommates.  If no one is getting along, they usually agree to it.  You notify the landlord of this with a letter signed by the other roommates that they agree that you are released, and that they are soley responsible for paying all of the rent.  Then have the landlord sign it and have them give you the signed copy.  This way if your roommates don't pay the rent, you can't get sued.
