Can i dispute a purchase which has no refund policy?

We made a jewellry set (which has 3 parts) purchase on mar 23 and we received 2 parts by 1st week of june. As per the terms on the receipt, lead time for delivery is 12-14 weeks. its been more than 22 weeks we haven't received the 3rd part yet. without the 3rd part on this set, it is useless. we are not getting any proper answer on ETA for the 3rd part. everytime we call their support #, we were told that we should get it in 10 days..This vendor has no refund policy. that said, what are my options here? We have submitted a complaint with bbb.org. any other sugestions? if we return what we received already (2 parts) and dispute the purchase with my credit card company, would it hurt us by any means (since the vendor has no refund policy)?

  1. I'd ask to speak to a manager at the company and tell them that you've spoken to a lawyer and plan to take them to small claims court if they don't comply with the third part.


  2. Call up your credit card company and explain the situation. They will either fight for you to get this fixed or they'll wipe the charge off your account and get the money back from the vendor.  

  3. A refund policy is when a a purchase in complete. Your sale is not.

    Take it to small claims court. This is what I did. They will probably not show which means you automatically win. They must pay up.

    Take it up with the credit card company. What do you have to lose?

    Maybe call the local newspaper. Here in Chicago out paper has a reporter who's only job is to point out fraud and help consumers like yourself.

    Company's respond immediately.

  4. you have irrevocable governmental (statutory) rights regarding this; they have failed to keep their end of the implicit contract, you are at liberty to do whatever you wish as a result of their failure to honour the purchase.

  5. the vendor broke the verbal or written contract that the third part would be delivered in 12 to 14 weeks. that means that the no refund policy is invalid since you didn't get all your goods when promised. go back to the vendor and ask for a refund and if he refuses then take him to small claims court.
