Can i file complaint against precinct or cops?

Saturday night 2 friends and I were aggressivly arrested by 6 cops for something we did not do. We were on a roof early morning, a bottle fell off ledge, a drunk, or weird pedistrian on street decided to tell cops we were throwing bottles at him which totally wasnt true, before we knew it cops busted up apt, ripped us out of apt no questions asked, they were rude, mean, and very aggressive, you would have thought we blew up a school or something, i have bruises all over my arms from the one mean cop before the nice cop took me away from him cuz he was about to go ape **** on me.... then in the precinct they guy cops said some demeaning stuff...like when i had to go into the bathroom again for female issues he was like what didnt you wipe your *** good enough the first time? needless to say it was h**l, i was innocent, did whole jail judge process and was let go, but now have bruises, and they didnt even give me a report of my arrrest, they are *** holes, ny cops suck!!!!!!!!!!

  1. Isn't magical how those things just fall and isn't terrible that a victim of the fall would complain WOW.

    If this was NYC then all you have to do is contact the complaint board, it is open 24/7 and make your complaint. http://www.nyc.gov/html/ccrb/html/contac... or call 311

    They can track down the officers.

    PS you have no right to a copy of your arrest report, your lawyer can get it before trial but not you.

    Also with your attitude get used to it, you will be in trouble again.

First of all, arrests are usually not a lovey dovey affair -- they require physical confrontation, and force is often necessary, even if only for safety.  The fact that you all were drinking alcohol (which you didn't say, but is obvious), does not go far in ensuring a passive arrest.  The fact that you claim you are innocent, is pretty much meaningless -- the cops have to look at the evidence -- and, in my opinion, the evidence suggests that you were LIKELY guilty of what you were accused of.  Remember, it is not a police officer's job to determine guilt -- just probable cause.  There are also no rules about how nice cops have to be to people -- especially drunkards who have been arrested (whether you are guilty or not).  Cops are jerks, but it would be nice if you were going to take responsibility for getting arrested.  Really, drinking on a roof in the early morning hours -- can you accept any responsibility?

  3. Yes you can file a complaint. Do so by calling the PD and asking for IA.

    BTW-We don't as policy give a copy of the report to anyone. You can go to records and order a copy.

  4. What were you actually arrested for, as in what was the reason.

    They had probable cause to go to the roof, but not necessarily into your apartment unless they had to, to get to the roof.

    When you say aggressive arrests, were you fighting back, trying to resist, yelling at the police?

    You can file a report against those officers if you really think that they did something wrong (I know its hard, but try to look at the situation objectively).

    If you are going to file a complaint, make sure to take pictures of the bruises. File a complaint at the precinct, then go to the DA's office and file a complaint.

    If you are not satisfied with the results (they're not going to do anything for you, or give you anything) go to an attorney, with the pictures, and tell your story and go to court in tort.

    If you're making this up (not saying you ARE, just giving you a heads up) you'll be in serious legal trouble.

    But yes, the judge can and will get to watch and hear everything from the cruisers as well as the jail.

You can file a complaint.  You need to see a doctor and have the wounds documented.  You need to take pictures NOW.  You will need an attorney to get through the whole process.  Honestly, the complaint probably won't do much.  The police are going to say they had a report of drunk people throwing bottles, and they found a bunch of drunk people with bottles, so the arrest was made with "probable cause".  What they saw led them to believe the report, so they are going to be protected from unwarranted arrest.  Still, you don't deserve to be treated worse than we treat animals, so by all means, make the complaint.
