I owed someone money. Unfortunately i wrote them a check, but by the time they cashed it, my account had insufficent funds, something i did not anticipate. Now the person is saying they are filing a police report against me...will i be arrested, what will happen? by the way i can pay this person cash but i am pregnant and he threatened me and that is the only reason he was not paid....what is the worse that can happen to me....scared! by the way i know i am stupid, i just need advice on what will actually happen

  1. If you decide to pay the cash, for goodness sakes, GET A RECEIPT!!!  Yes, it was a bad thing to bounce a check, but if you make the effort to pay in other ways (CASH), get that receipt!!  That document proves everything!


  2. pay him in cash and don't forget to get a receipt from him just in case he tries to say you didn't pay him !!

  3. You won't be arrested for that.  You can only be arrested for the check thing if it happens with large sums of money multiple times to the same place.

  4. He can demand, as any one owed money for a bad check, payment + costs incurred(bank of $30 etc).

    He can file a report of a bad check, against you with the fraud Unit, or Worthless Checks Unit for the checks issuance.

    The court will issue a warrant for you to appear and answer, why you did not pay the man, what you owed, after writing a bad check.

    You can pay the man or file a counter claim / report against him for threats which is against the Fair Debt Collection Practices Act 15 USC 1692 (d), Harassment or Abuse--which states that: (1) " The use of threat of use of violence, or other criminal means to harm the physical person, reputation, or property of any person." The laws about an unborn child and a pregnant mother can also be looked into as threats against an unborn child?

    Talk to an attorney and see what s/he says about above?

  6. First, if someone is threatening your safety, call the police and file a report.  

    Next, as for the insufficient funds, it is only a criminal act if you knew or should have known your account did not have the money.  There has to be an element of fraud or deception.  

    Try to make a agreement for payments.

  7. I'm not clear on what you were anticipating, but a check is a promissory note, and as soon as it is declined, it became illegal.

    I have no idea why other posters would say otherwise, but you can get arrested for bouncing a check. You can be looking at a fine, restitution, court costs, and any bank fees. If it wasn't illegal, wouldn't everyone write bad checks?

    Also, just paying him off may not be enough. If he cashed the check at a bank, they are now the victim because they are out the money.

  8. FIRST PAY THE PERSON. IF YOU PAY IN CASH GET A RECEIPT OR YOU'LL HAVE NO PROOF YOU PAID THEM. YOU ARE ALSO LIABLE FOR ANY BOUNCED CHECK FEES. IT'S A CRIME IF YOU KNOWINGLY WROTE A CHECK ON A BAD ACCOUNT AND YES YOU CAN GO TO JAIL. YOU CAN ALSO FILE CHARGES AGAINST THE PERSON FOR HARASSMENT BUT THE COURT MAY LOOK AT IT AS YOU ARE MALICIOUSLY FILLING CHARGES TO AVOID PAYING YOUR DEBT.

  9. That person is an idiot, you could told him to run the check through a second time, AFTER you had put more money in. Or they could have accepted the cash. But you will have to pay an overdraft fee at the bank if you did not have overdraft protection.If you are a habitual bad check writer,Yes you could get into serious trouble with the law.(fraudulent check writing) if you have trouble keeping your check book balanced go to your bank and an associate there can show you how to keep track.If not pay only by cash..everyone makes mistakes, chalk this up to a learning experience..  Good Luck..

  10. You wrote a hotcheck. Not only will your bank fine you for it, but their bank will fine them for cashing it. He can add that charge to you owe him. You are liable for that check you wrote, you promised him that money, they cashed it with the understanding you had the money in your account. If that person whats to take you to a small claims court you will lose and have to pay court fees as well.

    You can be arrested for writing a hotcheck.

    Next time save yourself the touble, buy a money order.

  11. First of all, no you won't go to jail. :)

    Second, if the dude wanted to be a jerk, he could take it to legal court and sue you. But I doubt that will happen.

    Meet with this dude, talk to him, and get it straighten out.  

  12. yOU KNOW THE MOST THAT CAN HAPPEN IS THAT PERSON TAKING YOU INTO COURT AND THATS THAT AND YOU COULD FILE A REPORT AGAINST HIS *** TEACH HIM ALESSON ALSO.

  14. Using a check to pay  with insufficient funds is a crime. Most places it is called fraud. What the police may do, if they have the time or manpower, is send you a letter or call you. Tell them that you can and will pay. They will usually arrange payment but it is better to get it over a dine with before that happens.

    Likely the threats were because you did not pay and they are upset, right?

    If so they will gladly take your money. Get a money order or certified check or pay in cash (get a receipt for the cash) and you are done.

    Once any payment is exchanged between you two it is no longer a police matter. The only thing the guy you stiffed can do then is sue and they won;t, They just want their money.

  15. Call the police department and ask if they have a warrant for your arrest. If they do ask about this. Maybe you have the money, .... call him back and tell him.
