Can i get compensation? Civil Action

hi, just wondering if i can get a civil action law suit against my next door nieghbour for en-dangering my life?

i will give you the short story :- she set fire to her kids bedroom while her husband was asleep in the next room and her kids and my sister and me was below her kids bedroom outside, she set fire to the curtains and was calling me to help her so i went in and put the curtains out, she was arrested and convicted in court (pleaded guilty) for arson with intent to endanger life, but she is a bit slow in her head if you know what i mean, she was only given comunity service,, ever since then (last year, i was 15) she has had a vendetta against us, and she set fire to her washing line last weekend and said it was us and went to her solicitor and they sent us a letter saying that if we continue with "this behaviour" she will take us t court! lol,

well anyway my mum said that she can take a civil action against her because she endangerd my life, and i was wondering if i can sue her, she owns a house also, how much could i get?

  1. Your neighbour was dealt with by the criminal courts and thats an end to the endangering lives part of the offence as far as you are concerned.

    I would like to add your language use and responses to correspondents on the site seem somewhat aggressive, and its rather disturbing that you seem to think you have a right to live a life in your home but your neighbour who YOU point out has some mental health issues shouldn't have that same right, with the hope of making some money on the back of it.

    No doubt I will be abused now.....Thank goodness I don't live next to you and your family!


  2. firstly go to the police and report this as harassment, then go and see a solicitor and you should be sorted pretty soon

I'm not sure where you live but usually minors cannot bring civil actions.  A legal guardian brings actions on behalf of the minor.  In the US, you bring a suit because you were damaged in some way and need to the court to fix the damage.  She could have really harmed you, but luckily she didn't, so there really aren't any damages.

    More importantly, shouldn't you move before she's successful in setting the house on fire?

  4. You are a minor so you can not. However your mother can on your behalf but I am not sure if she will succeed. your neighbour is obviously a danger to herself and others. Actually the best thing you can do especially if you are in rented accomodation is to move but if this is not possible your mum nees advice from a solicitor.

    Get Notes times dates etc. tell the whole truth even if it is against you. do not invent or eggagerate Iand (where the h**l is spell check)

The only thing i can see in your question that you´d be able to take a civil action on at your local county court is her behavior, i think you´d probably have to report it to the old bill and maybe the council, if she still goes off on one then apply for a restraint order again at your county court if she breaks this she could face jail time

    I would suggest that the quicker she outta your life the better.

    She had already been convicted of the offence, that will remain on her record and may be quoted should she try to drag you in

    FORGET IT is my recommendation you will just stir up more troubles

  7. I'm sorry but i don't think you can sue her for en-dangering your life

    as you said in your own words you was out side and went into the house of your own free will, if i asked you to go get my coat from the other side of a motorway it is still up to you if you try to cross it.

    if she had come into your home and set it on fire then yes you would have a case but she did not.

    if i was you i would buy a good CCTV unit and set it up to monitor what she does coz sooner or later she will hang her self.
