    YOU COULD BE CHARGED UNDER YOUR STATES OPEN CONTAINER LAWS, YOUR FATHER COULD BE CHARGED WITH OPEN CONTAINER, PUBLIC INTOXICATION, AND IN THE EXTREME CONTRIBUTING TO A MINOR.

  3. Yes.  As an under 21 driver, in the car with an alcohol violation (open containter), your license will be suspended for a minimum of a year.  Even if you weren't drinking, or touching the booze.

    It's a shame that your father doesn't have more sense than to  drink in the car. He shows a lack of rationality and I understand it may be difficult to stand up to him but it beats losing your license, your car and possibly going to jail. You need to refuse to drive him anyplace if he's got an open container, any container with him. Make him lock it up in the trunk the next time you drive him to the liquor store.

    Terry, Kelli is NOT correct. I wasn't the one who thumbs downed her but you brought it to my attention. You may have gotten cut a break but in 1998, as a part of the Transporation Equity Act for the 21st Century (TEA-21) Restoration Act, a new federal program was established to encourage states to adopt laws that prohibit possession and consumption of alcoholic beverages in the passenger area of autos (section 154 of 23 USC ) referred to as "open container laws". A state not in compliance will have federal highway funds redirected to alcohol impaired driving countermeasures under the State's section 402 appropriation. States in compliance include Florida.

    The only circumstance that would prevent the driver as well as passenger being cited would be if the vehicle is used to transport passengers for a fee, taxis buses etc. or because the citing officer was cutting the driver slack for some reason. Maybe they were convinced the driver had no choice, didn't know or they had a cute smile :).

  11. In almost all states (except Missouri I believe) it's illegal to have an open container of alcohol in the car while it's moving.  The driver is held responsible.

Kelli, got a thumbs down and she is correct!  Here in Florida, who ever is caught with the open container in his hand or around him will be ticketed and be responsible.  You will not get in trouble as the driver..  Thats the law here in Florida.   Its the same as seat belt law - Driver has his seat belt on and passenger gets a ticket for not wearing his..EDIT:  Kim - why is that when they pull people over and find weed in the car they ask someone to step up and take the blame for it..  Whoever is in immeditate reach is responsible..
