hi,

i got married 2 years ago. The marriage was condicted in Satara district (in maharashtra), but we live in another district (Pune, in Maharashtra).

Now i want to get the marriage certificate, but someone told me that i must get it from the district where i got married. Is it really required to get the marriage certificate from the same district (i.e. Satara)) where the marriage ceremony was carried out? can't i get it from my permanent residence location district (i.e. pune) where i live since last 20 years with my family and all my documents (like passport, etc.) contains same pune's address?

  1. No.

As per law, it is required to get the marriage certificate from the place where the marriage ceremony was carried out, and you will also need the  signature of  'bhategee" (pandit), and some local witness's sign who were present at your marriage.

  2. no, u can get it done in pune alsol. go to the office of marriage registrar. u will find lots of lawyers hanging around there, catch hold of one, pay his fees and get the job done., the lawyer will advise u about all the paper work involved

  3. I fully agree with whatever you state in your question here. The purpose of registration of marriage is to have a proof of valid marriage between the parties & not to see where that marriage was solemnized or where the parties usually reside. The very fact the Supreme Court of India has strictly recommended all the States in India to make registration of marriage compulsory irrespective of the religion of parties, but in India each State has its own State law/rule with regard to Marriage Registration under section 8 of the Hindu Marriage Act, 1955. Some States such as Delhi allow registration of any Hindu Marriage in Delhi if either of the Party to the marriage has residential proof of Delhi even if the Marriage was solemnized anywhere in India, In State of Haryana the very first condition for registration of Marriage under the Hindu Marriage Act,1955 is that the Hindu Marriage should have been solemnized in the same District where the registration is applied for & further either of the party should have proof of residence in that district. Now as per your statement a similar law/rule exist with regard to registration of Hindu marriage under the Hindu Marriage Act, 1955. The only thing which I can recommend you is to either get the marriage registered under the Hindu Marriage Act, 1955 in Satara District where it was solemnized, or get this Marriage registered under the Special Marriage Act, 1954. This Act also provide the registration of any marriage which was performed according to any other form anywhere but after its registration under this Act the marriage will be covered under this Act only. This marriage can be registered under this Act in even Pune. Another marriage registration enactment which exist in Maharashtra & Gujarat State is the Bombay Marriage Registration Act, under this Act you can get your marriage registered any where in these States but here the signature of the priest on the application form for the marriage registration, marriage certificate from the priest & proper identity proof of the priest who solemnized is required, if you can get the priest & all these documents etc then get your marriage registered under this Act even in Pune.
