Can i get my deposit back?

heres the situation, i moved into an apartment and when i moved in it was supposed to be a secure building meaning you have to have a key to get in but not long after i moved here the big picture window by the front door to the building had gotten broken and i assumed that the property manager would replace it but that was over three months ago and its still cracked, there was also a lock on the door to the building and someone decided they would put superglue in the key hole but instead of fixing it she took the lock off the door, also the rubber trim stuff in the bathroom had fell down because there's no drywall to hold it up there and it looks like the wall is rotting, its a month to month lease and i want to move, my questions are if i move i want my deposit back and i don't know what the guidelines are for that how do i find out and if there was a security door when i moved in and she took the lock off is that a breach of contract?

  1. The deposit is for damages and for unpaid rental expenses.

    Since you are on a month to month, you have to give your LL a 30 day written notice to leave...send it certified mail, signature required so they cannot deny receiving it.

    Pay up, leave the place clean and make sure you have the LL present when you do a walk through and take pictures.

    She could say she is having trouble getting it fixed.


  3. You are m2m, you don't have to go through a litany of complaints. Simply give your 30 day notice and leave the place cleaner than you found it. Do a walk-through with the landlord and take lots of photos.

  4. If you have a month to month agreement, there does not need to be a breach of contract in order for you to move. Simply give her 30 days notice (send it certified). In your notice, request a walkthrough and get the details of this in writing. Include your new address so that any security deposit can be returned to you. Remember to take pictures with something dated (like a newspaper) for documentation of the condition of the place when you left.

  5. Oh, you can get your deposit back.  When I rented a studio type townhouse, I forgot about my 3-month deposit.  My landlady (May her soul rest in peace, Amen.) was the one who reminded me about the deposit.  So, when I left the townhouse, I had enough money to spend for my things when I moved out.
