Can i go after an insurance company for more than there set amount on liability?

  1. no, the insurance company is only responsible up to the policy limit


  2. I assume you are asking about a liability claim.

    The most an insurance company can pay is the limit of liability. It does not matter how many people were hurt or the severity of the injury. The policy limit is the max amount payable.

    If your damage/injury exceeds the at fault person's liability limits - you will need to pursue your own Under-Insured Motorist coverage for the rest. UIM is not a required coverage. Hopefully you purchased it.

    Please report the claim to your company and let them know the other person may not have sufficient limits. The adjuster with your company will be able to walk you through the process.
