I am in love with my fiancee we've been together 5 years, hes a US citizen, but I'm in the US with OPT since i graduated from a college in this country, we want to get married, and i was just wondering f i could go to my country in december and come back while the petition is still in process. My OPT ends in at the end of this year, he told me the best thing would be to get married soon so i don't have to go back to my country and leave him here. Any info will be greatly appreciated, and I thank you very much before hand!

is this correct?

- Get married

- Once married and i have the marriage certificate in hand my husband files the following forms:

* I-130

* G-235A

* I-864

when i come back i'm going to file for residency

  1. you need to pay the money for the lawyer!

  2. You DON"T come back! If you leave the country while you have an I-130 pending you have abandoned your petition! Get married, file the paperwork, (including a I-131 application for travel document), when you get the advanced parole you use that to leave and return to the US. Good Luck!

  3. Getting married will only complicate the application process. If you leave and try to return after your card expires the authorities well refuse you entry.
