Question:

Can i press any charges against an 11 yr old kid that punched my 11 yr old and busted his head?

his mom was as bad as he was yelling the F word in front of all the neighborhood kids and totally making a *** out of herself.....3 witnesses said that my child did nothing but defend himself.....this kid had had a lot of fights in the neighborhood and people are getting sick of it.......should i just drop it?..........is there anything i can do.....help

  1. With heavy grunt from a man with kids.....

    First of all charges at 11 will not ruin his life. The police may choose to do nothing but maybe having them show and investigate might motivate the mother. Plus it would be on record in case something else happens.

    So now your child and others are afraid and have to deal with fear everyday. I was that kid. Now I am a super serious military guy but I remember when I was a little geek and I was afraid to leave the house because of the local bully.

    What happens if some kid gets hit in the head just so and they lose sight in an eye or something? You have no choice. You have to protect your family. That means you MUST call the police and let them deal with it. That will put the scare in the kid and his mother.

    What happens if there is another fight and this horrible mother decides to have YOUR son charged? With a prior police report you will be protected.  

    Pardon my going on..... Years ago at about 13 I had this kid terrorizing me and beating me up all of the time. The day came when I stood up for myself, got lucky and creamed the kid. It was a military base so much was made of it.

    A few years ago I was putzing on the net and found some site for military brats and posted my email. They guy I creamed emailed me and we speak back and forth now.

    I as the Uber geek learned a valuable lesson that day..... that I could stand up for myself and no longer be afraid. My geek boy self became an Army Green Beret. That confidence has taken me far in the world.

    He as the bully after all that happened realized he was on the wrong path. His parents did as well. He is now a tenured professor at an Ivy league college. A thoughtfull and deep thinking academic.

    Point is we both needed to learn some sort of lesson. You need to call the police right away. You might actually make a difference in a young boys life once he realizes that there are repurcussions.  


  2. If an 11 yr old commits battery, it's still battery. Being a child doesn't make one immune from abiding by the law. That is why there are juvenile courts and adult courts. The law recognizes that juveniles require special punitive measures that aren't as harsh as those an adult would get. But it doesn't mean that they can do what they want without consequences. Sometimes, the parents are unable/unwilling to exact consequences so the court system has to.

    In your situation, call the police and file a report. Even if they don't press charges, you're setting a precedent. The next time the kid beats up on another kid, the police can see a history of violence.

  4. cops yes...social workers i dont think so. they may get involved but i wouldnt seek it at this point, all the gov. usually does is make things worse. certainly they should pay any medical bills

    sounds like their are lots of anger problems in that family,they need help.

    Do not drop this your childs life could be at stake, this other is child is being abused if he is being talked to in that manner

You should contact your local police department.  There are things that they can do to bring the parent and child in to line.  They could be taken to family court and a family court judge could assign social workers and others to look into the matter.  The kid you mention sounds like he needs serious help and now is the time to start some sort of intervention with the authorities who are there to deal with these situations.
